Obama-Romney showdown starts with a harsh tone

(AP) ? The 2012 presidential general election has begun. It won’t be pretty.

Tuesday marked Day One, in essence, of the contest between the two virtually certain nominees, Republican Mitt Romney and President Barack Obama. Rick Santorum’s departure removed the last meaningful bump from Romney’s path to the GOP nomination. Romney and Obama wasted no time in portraying the voters’ choice in dire, sometimes starkly personal terms.

With Obama saddled with a still-ailing economy and a divisive health care law, and Romney riding a wave of blistering TV ads, the fall election is unlikely to dwell on “hope,” ”change” and other uplifting themes from four years ago. Much of the nation’s ire then was aimed at departing President George W. Bush, and Obama had no extensive record to defend.

The landscape is much different now. Americans face nearly seven months of hard-hitting jabs and counterpunches between the two parties’ standard-bearers.

Romney, the former Massachusetts governor making his second presidential bid, attacked Obama with gusto Tuesday in his two public events that followed Santorum’s surprising announcement.

Campaigning in Pennsylvania, where an April 24 GOP primary is suddenly less important than its likely role as a battleground state this fall, Romney portrayed Obama as a weak leader who apologizes for America’s greatness and prefers European-style socialism over robust free enterprise. Obama’s allies call such claims nonsense.

“The right course for America is not to divide America,” Romney told a GOP dinner gathering in Mendenhall, near Philadelphia. “That’s what he’s doing,” he said of Obama. “His campaign is all about finding Americans to blame and attack, and find someone to tax more, someone who isn’t giving, isn’t paying their fair share.”

He said Obama prefers “a government-centered society.”

Obama, campaigning in Florida, said the choice this fall will be as stark as in the 1964 contest between Lyndon Johnson and Barry Goldwater, which resulted in one of the biggest Democratic landslides ever. That election included dramatic and controversial moments, such as Goldwater’s defense of “extremism in the defense of liberty” and a devastating TV ad suggesting a Goldwater presidency would lead to nuclear war.

Obama didn’t mention Romney by name. His top aides have shown less restraint, however.

Obama campaign manager Jim Messina said in a statement after Santorum’s withdrawal: “It’s no surprise that Mitt Romney finally was able to grind down his opponents under an avalanche of negative ads. But neither he nor his special interest allies will be able to buy the presidency with their negative attacks. The more the American people see of Mitt Romney, the less they like him.”

Other Obama campaign officials have mocked Romney’s wealth and called him out of touch with average Americans.

Romney and his allies, including a potent super PAC, have proved their ability to raise millions of dollars to air brutally effective attack ads, which crippled Santorum and Newt Gingrich in the GOP primary contests. Obama will raise many millions, too, and few doubt that he will hit Romney hard.

On Tuesday, Romney made clear that he will go after Obama’s character as well as his record. In speeches in Mendenhall and Wilmington, Del., Romney said Obama isn’t merely inept at economic policy, he actively dislikes business.

Obama “is clearly trying to hide from us what he intends to do,” Romney said in Wilmington. “He’s going to hide. And it’s my job to seek.”

Romney made similar remarks last month. Now, with Santorum off the stage and Gingrich and Ron Paul hardly a factor, there are no intra-party distractions to dilute such comments. Romney and Obama are fully engaged, one-on-one, at a much earlier stage than in 2008, when Obama had to parry Democratic rival Hillary Rodham Clinton throughout the summer before fully turning to Republican John McCain.

Even then, Bush’s unpopularity helped fuel Obama’s campaign and deflected some of the anti-GOP sentiment away from the actual nominee.

This time, the incumbent president is on the ballot, with unemployment above 8 percent. The tea party, which didn’t exist in 2008, is a potent and unpredictable force.

And Romney suddenly is free of meaningful primary worries. That leaves him able to focus the full force of his fundraising and campaigning skills against Obama.

Kaspersky PURE 2.0 Total Security

Antivirus and firewall protection together form the bare minimum for a security suite, and some products stay close to this minimum. Kaspersky PURE 2.0 Total Security ($89.95 direct for three licenses) lies at the opposite end of the suite spectrum. In addition to antivirus, firewall, antispam, antiphishing, parental control, and all the expected components it adds backup, system tuneup, file shredding, encrypted storage, password management, and much, much more.

Since its initial release last year, Kaspersky PURE has undergone a bit of fine-tuning. Its user interface now appears strictly in muted greens and grays, eliminating the previous edition’s multi-colored icons. Some features are more easily accessible, others have had their configuration settings revamped. Kaspersky PURE now uses exactly the same antivirus engine as Kaspersky Anti-Virus 2012 ($59.95 direct for three licenses, 3.5 stars), and it can check file reputation using the massive Kaspersky Security Network (KSN) database. You can even right-click any file to see what KSN knows about it.

Excellent Lab Results
Kaspersky routinely attains top honors in independent lab tests. In both on-demand and retrospective tests by AV-Comparatives.org, Kaspersky’s technology received a rating of ADVANCED+, the highest rating. It also took ADVANCED+ in this lab’s dynamic whole-product test. In fact, AV-Comparatives named Kaspersky product of the year for 2011.

In the latest certification test for Windows 7 antivirus by AV-Test.org, Kaspersky took 17 of 18 possible points, more than any other product. Its score of 16.5 in the parallel test under Windows XP was beaten only by Bitdefender.

Both ICSA Labs and West Coast Labs certify Kaspersky for virus detection and removal. West Coast gave Kaspersky a number of other checkmark certifications and named it a “Checkmark Platinum Product.” About the only test Kaspersky didn’t ace was Virus Bulletin’s VB100. A single false positive can cost a product certification in this static test, so passing in just 8 of the last 10 VB100 tests isn’t a big worry. For more about the labs and how I interpret their tests, see How We Interpret Antivirus Lab Tests.

Reality Check
Kaspersky PURE 2.0 is the very first product I’ve tested with my new malware collection, so I didn’t really know what to expect. On over half of the infested test systems the product installed without issue and launched an unusually lengthy initial update; I timed the installation at five minutes and the update at 15. On a few of these systems Kaspersky requested a reboot right away, to handle active malware.

Malware interfered with the installation on several systems. Kaspersky tech support supplied a cleanup tool that solved most of these. However, two test systems required days and days of going back and forth with Kaspersky tech support.

Kaspersky’s script-based repair system did impress me. Under instruction from tech support I ran several diagnostic tools and sent them the logs. The next day they sent back a script to fix the problems revealed by the logs. Malware bluescreened one system during scans, disabled connectivity on another, and reconfigured Windows to make launching programs from icons or menus impossible; this is nasty stuff! Script-based cleanup eventually solved almost every problem, though one entrenched threat simply couldn’t be removed.

Tech support did yeoman work to get Kaspersky installed and running on these infested systems, but I’d be happier with a product that just did the job, without needing any help. As I test more antivirus tools under this new malware collection I’ll find out just how close they can come to that ideal.

Decent Malware Cleanup
Kaspersky detected 76 percent of the new malware collection and scored 5.3 points overall. That’s not so great. Norton 360 Version 6.0 ($79.99 direct for three licenses, 4.5 stars) detected 88 percent of the previous collection and scored 7.4 points. Comodo Internet Security Pro 2012 ($4.99/year direct, 4 stars) detected more, 97 percent, but less effective cleanup earned it second place with 7.3 points.

Once again, Norton and Comodo earned these scores against a different malware collection. On the other hand, Kaspersky Internet Security 2012 ($79.95 direct for three licenses, 3.5 stars) detected 76 percent of that collection and scored 5.7, so the current product’s results may be right in line.

Rootkits are especially troublesome because they interfere with Windows to hide their traces. Looking at the subset of samples that use rootkit technology, Kaspersky detected just 60 percent. It did a good job removing what it detected, so it scored 5.6 points for rootkit removal. Most products tested under the previous malware collection detected 100 percent of the rootkits; Norton won that test with 8.9 points.

I was impressed with Kaspersky’s post-scan Windows troubleshooting tool. This tool looks for and repairs security changes and other configuration changes left behind by malware. In testing it re-enabled a disabled REGEDIT and repaired settings that limited my use of Windows Explorer. You can launch this scan manually if desired. Kaspersky can also scan and fix insecure Internet Explorer settings and check your system and applications for unpatched vulnerabilities.

Because it scores so well in the independent lab tests I’m giving Kaspersky 3.5 stars for malware removal. Based solely on my own tests it would’ve received a lower rating. For an explanation of my testing methodology, see How We Test Malware Removal.

‘Lion King’ is Broadway’s all-time box office king

NEW YORK (AP) ? Very quietly, almost stealthily, a new king has been inaugurated on Broadway.

Box office figures released Monday show that “The Lion King” last week swiped the title of Broadway’s all-time highest grossing show from “The Phantom of the Opera.”

The cumulative gross for “The Lion King” is $853,846,062, according to the show’s numbers. Its chandelier-swinging rival’s cumulative total is $853,122,847, according to the musical’s publicist. The “Lion King” surged past “Phantom” after netting over $2 million at the box office for the week ending Sunday, while “Phantom” pulled in about $1.2 million.

What makes the achievement all the more remarkable is that “The Lion King” chased down and grabbed the title despite “Phantom” having almost a full 10 years’ head start. The Disney show opened in November 1997, while “Phantom” debuted in January 1988.

The upstart’s victory is due in large part to its higher average ticket prices and a slightly larger theater. Monday’s data shows “Phantom” had an average paid admission of $98.97, while “The Lion King” fetched $155.09.

“It doesn’t surprise me,” said Cary Ginell, a music historian and biographer who edited the seventh edition of “Broadway Musicals: Show By Show.” He compares “The Lion King” to a Disneyland ride.

“It’s a spectacle that satisfies on many different sensory elements ? audio, visually, emotionally. It’s also good for all ages ? just like Disneyland is. For the kids, it’s the visual elements ? the colors, the costumes and the puppetry. For the adults, it’s ‘Hamlet,’ basically. And the music is not geared to one age or gender or race. It’s as universal a show can get.”

Disney Theatrical Productions was gracious when contacted about reaching the milestone, saluting “Phantom” song writer Andrew Lloyd Webber and “Phantom” producer Cameron Mackintosh, who also co-produced Disney’s hit “Mary Poppins,” and calling their show “a global phenomenon of historic proportions.”

Thomas Schumacher, producer and president of Disney Theatrical Productions, also gave credit to Julie Taymor, the director, costume and mask maker of “The Lion King.” ”Her vision, continued commitment to the show and uncommon artistry account for this extraordinary success,” he said in a statement.

“This accomplishment belongs to our audiences, millions of whom are experiencing their first Broadway show at ‘The Lion King,’” Schumacher added. “Surely, introducing so many to the splendor of live theater is our show’s greatest legacy.”

The Broadway League, a trade group that collects revenue from theater owners, has slightly different numbers, putting the cumulative grosses of “The Lion King” at $854,038,152 and “Phantom” at $853,122,847 as of Monday. The League in 2009 changed the way it calculates grosses, which may explain the discrepancy. None of the figures are adjusted for inflation.

To be sure, “Phantom,” now in its 24th year, is still the longest-running show in Broadway history, with more than 10,000 performances and it has sold many more tickets than its Disney rival on the Great White Way, a staggering 14.8 million so far.

In comparison, “The Lion King” looks like a pup: It is the sixth longest-running show on Broadway with over 5,900 performances over 14 years and has sold just over 10 million tickets.

“The Lion King” may now have won on Broadway, but “Phantom” is still a juggernaut elsewhere. Its producers have even declared it the most successful entertainment venture of all time, with revenues higher than any film, including “Titanic,” ”Star Wars” and “Avatar.”

The total worldwide grosses for “Phantom” are estimated at over $5.6 billion, while the worldwide haul for “Lion” is $4.8 billion. “Phantom” has also been seen by 130 million people worldwide, while “Lion” puts its number at 64 million. Those gaps may also close: “The Lion King” has seven ? soon eight ? productions worldwide, while “Phantom” has seven productions around the world: London, New York, Hungary, Japan, South Africa, Las Vegas and a UK tour.

Ginell points out that about 40 percent of “Phantom” tickets are sold to repeat customers, an extremely high number. Plus, 68 percent are women. “‘Phantom is kind of a live-action romance novel,” he said. “I think that’s what’s attracting a huge percentage of women to the show.”

H. Todd Freeman, vice president of operations at ticket broker Applause Theatre & Entertainment Service, Inc., said the success of “The Lion King” is due to its family draw, big visuals and ticket prices that were double those for “Phantom” when it started.

Both shows now use premium pricing ? offering deep-pocketed theatergoers the best seats for a hefty mark up. On Monday, both shows had top premium tickets of about $200. Even so, “The Lion King” still commands a higher average ticket price and shows no signs of softening.

“Will it make 25? I don’t know,” said Freeman, who admits he never thought rival “Phantom” would last this long. “It holds up pretty well all year long but the times when it is the strongest is the Christmas breaks, the Easter breaks, the Spring breaks and the summertime.”

The two share some attributes: Both have musical giants behind them: “Phantom” has songs by Lloyd Webber and is directed by Harold Prince, while “The Lion King” features music by Elton John and lyrics by Tim Rice and the vision of Taymor.

Both have multiple Tony Awards, movie tie-ins, simple-to-understand stories and are spectacles ? important for attracting tourists whose command of English might be weak. Both are not dependent on having stars on stage. And both call home in similar-sized theaters, “Phantom” at the 1,605-seat Majestic and “Lion” at the 1,677-seat Minskoff.

The staying power of each is remarkable. Over their first 750 playing weeks ? which “The Lion King” has recently reached ? they’ve played to roughly the same number of people: “The Lion King” at 10,092,235 and “Phantom” at 9,241,333.

Most shows that have achieved a ripe old age never appear in the top 10 by this point in their ages, but both “Lion” and “Phantom” are still routinely among the top earners, week in and week out. On the other side of the ledger, over 500 shows have opened and closed on Broadway during lifetime of “The Lion King.”

Ginell tips his cap to the new box office king and doesn’t see a time soon when it abandons its kingdom. “‘Lion King‘ is the perfect family musical and I think it always will be as long as expenses don’t go so far up that they won’t be able to afford to put it on anymore.”

ACLU: Police request cellphone records without warrants

1 day

Virtually all of the 200 law enforcement agencies that responded to public records requests filed by the ACLU track cellphones without warrants, with several falling far short of probable cause, according to a new report.?

The report comes as the intersection between technology and privacy reaches a crescendo. Concerns over Google’s new privacy policy, recent tracking software and Facebook’s Timeline are making many Americans squirm over the invasiveness of the sites and devices that define our lives. It’s apparent law enforcement — usually in the pursuit of ?investigations, mind you — can and will find out who you are and where you are if they need to, as anyone who watches any TV crime procedural knows is par for the course.

It’s been about a year since the last major dustup over cellphones and privacy, when surreptitious location tracking on mobile devices stirred Congress into action, prompting even Steve Jobs to respond to the allegations.

More recently, the presence of the Carrier IQ tracking software on many cellphones has sounded panic bells among privacy advocates, leading to a proposed cellphone privacy bill. The ACLU filed nearly 400 requests under freedom of information laws in the fall asking state and local agencies about “policies, procedures and practices for tracking cellphones.”

In a statement, the ACLU said:

The responses varied widely, and many agencies did not respond at all. The documents included statements of policy, memos, police requests to cell phone companies (sometimes in the form of a subpoena or warrant), and invoices and manuals from cell phone companies explaining their procedures and prices for turning over location data.

But, the report shows the vast majority of the agencies from 20 states responded that they did engage in some kind of cellphone tracking, with New Jersey and North Carolina responding with the most instances. Only 10 agencies reported that they did not track cellphones.

In?Chatham County, North Carolina, law enforcement practices “real-time GPS tracking of cell phone on ‘reasonable suspicion’ standard,” including other numbers tied to their targets.?

Catherine Crump, staff attorney for the ACLU Speech, Privacy and Technology Project, told msnbc.com of some of the more egregious findings:

We discovered that police in Cary, N.C. requested from Sprint a list of all phones that had used a particular tower — meaning they were obtaining sensitive information about many people they had no reason to suspect were involved in a crime. ?We also discovered that several agencies deliberately try to keep secret the fact that they engage in cell phone tracking. An Iowa City police training manual instructs officers, “Do not mention to the public or the media the use of cellphone technology or equipment used to locate the targeted subject,” and also advises officers to keep that information out of police reports. ?Finally, some police departments find this information so valuable that they have purchased their own cell phone tracking equipment. ?Police in Gilbert, AZ, for example, spent $244,000 on cell phone tracking equipment.

At the opposite end of the spectrum are the officers in Lexington, Kentucky: “In regard to the acquisition of cell phone location records, data, and/or information, such?items can be obtained only with a search warrant.”

While the ACLU found “most law enforcement agencies that responded engage in cell phone tracking for investigative purposes,” other agencies tracked the devices for other purposes, such as locating missing persons.

The report also found how compliant major carriers were to law enforcement requests, and how “there are hundreds of invoices from mobile carriers to law enforcement agencies that contain pricing data.”

One example from Tuscon, Arizona shows “T-Mobile charges $150 for one hour’s worth of data about what phones were?near one particular tower,” while other documents uncover charges of $30 to $60 from Verizon Wireless for “15 minutes worth of tower data.”

Documents from local law enforcement, such as the Bellevue Police Department near Seattle, reveal requests to carriers made through “911 Exigent Circumstances” form that covers suicide attempts, missing pesons, assaults and other instances where “one or more people face immediate danger of death or serious bodily injury.” While they can request historical information — and some departments do — in Bellevue at least they stick to current subscriber and billing information, as well as real-time data in locating the number in question.

Mobile carriers are also retaining user information for months, even years, with Verizon keeping location records for “one rolling year,” while “T-Mobile keeps them for ‘officially 4-6 months, but really a year or more.’” Sprint holds onto them for 18-24?months and AT&T “since July 2008.”

Crump told msnbc.com that the ACLU has “not aggregated the amount of money that mobile carriers have received nationally from law enforcement through the disclosure of location records. It is likely, however, that this number is substantial.”

As for responses to the report, Crump said, “So far, we haven’t heard of any agencies changing their standards for cellphone tracking. Although the state of the law is confused, and each police department seems to have its own standards for when and how to engage in this tracking, we’re not aware of any agencies rethinking their policies in light of our inquiries. Many agencies have refused to give us any information about their use of cellphone tracking, claiming the public records laws exempt them from having to disclose this information.”

That’s where the ACLU differs from law enforcement, as Crump told us:

The public has the right to know under what circumstances their local police are tracking cellphones. Location information is sensitive, and can paint an intimate portrait of someone?s life. It can reveal their daily routine, and deviations from that routine. It can reveal where a person goes to the doctor, who his or her friends are, and what political or civic organizations he or she patronizes. This isn?t the sort of information law enforcement agents should be collecting without the safeguard of going to a judge and proving to that judge that there is a good reason to believe that a search will turn up evidence of a crime.

In a statement, the ACLU said it:

supports bipartisan legislation currently pending in both the House of Representatives and the Senate that would address this problem called the Geolocation Privacy and Surveillance (GPS) Act. It would require law enforcement officers to obtain a warrant to access location information from cell phones or GPS devices. It would also mandate that private telecommunications companies obtain their customers? consent before collecting location data. At least 11 state legislatures are also considering bills related to location tracking.

It also provides an interactive map of the agencies and their responses. Clicking on the map opens up links to the documents, so you can check out what’s going on in your own backyard, if local law enforcement in your area was part of the records requests.
